I agree that the biker will be more injured or dead, but the people in the car does not get off Scot free..even if they walk away with just a car that is now a write off....
I am talking post traumatic stress and guilt feelings if someone has died/paralyzed. Most likely they are facing reckless driving charges or man slaughter chargers if some one dies in an accident.
And then It may be the biker that has caused the accident by flying between cars and was not fast enough to prevent from slamming into a car that is crossing lanes.

Agreed. Last Friday night, Terrace Rd Edenvale (around the corner from me). 24 year old biker (actually bike rider as there is a difference), 16 yr old passanger, 3 18-20yr olds in a Hyundai I20... Rider dead, both passangers in car dead, bike passanger died this friday in Milpark Hospital. Car was on it's roof, bike was torn in 3! No-one knows what happened as driver of car in ICU, sedated. So I say slim to none, but not impossible for it to happen.

Get stuck in a long line of traffic, check oppisite flow, when safe, cross the centre island and head back in the opposite direction. Obviously would not just drive into moving traffic.. Among my business interests, I am in partnership with my father, we own a driving school... A very reputible national driving school that I can not mention the name of because you will all know which one - you have seen our vehicles and offices. I drive like I teach (exept for the centre island thing)...

Cos your city is DA run... A governing body that can do the job... I am Ekhuruleni, and you know what incompitent provincial gvernment controls things here.. lol :lol:
And BTW, pavement parking only illigal on a public road or in a public area.. That is national law and cannot be superseded by provincial by-law. If you get a fine at a shopping centre where there is a parking area, don't pay it, go to court and win... That is private property and does not belong to council, traffic cops have no durisdiction in private property. The worst that could happen is the centre can wheel clamp, and even that is risky as they are private entities and not law officials, so you can nail them for destruction of property if the clamp makes even the slightest scratch on your cars wheel. If they refuse to remove the clamp because you refuse to pay them a fine, you can sue them too because no private citizen or entity can issue a fine of any sort unless you agreed contractuly before hand in writing with a signature that you would pay any amount if you disregard their rules. I have once cut a clamp off at Stone Ridge centre! They clamped my wheel, I told the security gaurd that he has 5 minutes to remove the clamp! He refused, I phoned one of my staff (My factory is nearby in Sebenza) to bring a generator and an angle grinder. He arrived in about 10 minutes, I cut the clamp off and left, never heard anything ever again - and that was about 3 years ago. And yes, the stupid security guard must have noticed that the .45 on my hip was far more intimidating than his little stick!
Bottom line: Private property is axactly that - Private - not public.

What I would like to add (and this is not a dig Stamina) The climbing Islands and turning around is not a big thing to me, except when it is done at the expense of oncoming traffic, which is more the rule than the exception. Guy's who "make" parking's are seen by the majority of the rest of the population as arrogant, as they generally "make a parking" that affects everyone else. So, if everyone who drove an SUV / Bakkie etc had the same approach as you do, maybe they would not be looked at in such a bad light . . . . . .
Stupid question here..... Is a pavement NOT part of a public area as private property ends at the beginning of a pavement kerb/curb ??? and yes I am asking about shopping centre pavements.

And what about Metro Police? Don't they have a slightly different "law" that they work under?

Agreed... Like I said, I will obviously check for a safe gap if I turn over the centre island and will also check for a cop. And, not that I always do it, but there are occations when one is late for something important and can't sit in that traffic.. "Boer maak n plan" comes into effect. I see it as my advantage having the vehicle that can get me out of that situation. Also a reason why I am on my bike more than in my bakkie... Zip between the line of cars at the robot and move off first when the light goes green. My bike can fit past your car, my advantage, you stay in the queue... And I never endangered anyone doing it.
As for the parking thing... I do not park where it would effect someone else, simply mean that many places have sections of pavement that are unused and only there for the architectural asthetics of the parking area. No-one will walk there or do anything else there, so I park there! I am in anyway the kind of guy that does not "take kak". Rules suck and I hate being told what to do! I park there cos not "security guard" with zero authority will tell me what to do! Best he shuts up and waits for his R400 paycheck at the end of the week! Arrogant sounding - I know, but it is just me, I do as I please, you want me to do as you please? Well then you better have a bigger stick than mine!

My old man ex-cop... Superintendant for 22 years, license testing officer for 8 - hence the birth of a driving school. So we know the traffic laws pretty much inside out. When I said that I have never got a fine, I acually meant that the 3 I have got were defended in court and I won every time! One for no numberplate, one for expired license disc, one for speeding. All ruled in my favour. Been pulled over a few times and been through road blocks, but the second the cop hears that you know the law, they let you go. They hate court!
The problem is that todays cops are trained in six months! Impossible to learn and know the entire traffic act in that time. If you get a fine in a parking lot, simply find out weather that parking was the property of the owners of the centre or if they leased the property from the respective counsil. If it is owned by a private entity (non-government entity), then that fine is not valid. Would you pay a fine for not wearing a seatbelt in your own driveway? The oil leak fine is illegal if that turns out be property owned by a private company, business or person. The fines are only valid if that is council property. Remeber though that driving recklessly or negligently or comitting other such "moving violations" in a parking area (private or public) can attract a legal fine as even private property like Checkers parking lot will have volumes of puplic utilising the area and endangering the pubic is illegal anywher, including private property.
As for the "pavement" being private or public, depends on what pavement... Could be at the border of the parking whereby it may or may not fall under council property, that all depends on where the owners property ends according to blue prints and his deed of title. I am refering to actual sections of raised paving or grass or islands well inside the parking lot.
As for our cops... Metro Police are essentially "traffic police". The only difference is that along with traffic control, they are to enforce by-laws (like checking dog licenses or illegal dumping, etc. They are also expected to assist S.A.P. cops in there duties... So basically traffic cops with SAP privilages. They can arrest you for a crime totally unrelated to a traffic offence. They are restricted to durisdiction and have no provincial or national durisdiction.. A JHB Metro cop can not fine you in Ekhuruleni, and vice versa...

Has anybody noticed the lack of @LeeEC the past day or so? What IS clear is that I certainly seem to have a gift for getting a thread red hot and keeping it there smile So I think you guys need me to throw you a bone or two... as it's clear you did not pay attention when I said your toys would not impress... @Stamina you have made a lot of claims regarding your ability to "get there first"... you will have to prove your claims my friend... but I do believe that getting there first is quite the opposite of what I would consider "stamina"... :twisted: It is clear you will all need instructions... perhaps I will send you all seperate invitations and the one who figures out the venue first will get there first..... Btw, I do approve of the photographic offerings so far... you'll do, you'll do... whip But I see only some of you are taking this seriously... So when I said I wasn't clear on what I would get out of this, I meant, beyond sticky, lemony and salty, I really don't understand why I'm coming to this event if that's all that's in it for me....
